By accessing or using Whop Sports ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

Whop Sports LLC is currently in the process of incorporation in Wyoming. These Terms constitute a legally binding agreement between you and Whop Sports LLC.

2. Description of Service

Whop Sports provides sports betting data analytics, odds comparison, arbitrage detection, and advanced statistical analysis ("Pro Analytics") for subscribers. The Service aggregates data from multiple sources including sportsbooks and prediction markets.

IMPORTANT: Whop Sports provides data and analytics for informational and entertainment purposes only. We do not provide betting advice, recommendations, or guarantees of profitability. All betting decisions are made solely at your own risk.

We do not warrant that:

• The Service will be uninterrupted, secure, or error-free
• Data provided through the Service is accurate, complete, or up-to-date
• Any particular results or outcomes will be achieved
• Defects will be corrected

Third-party data sources may contain errors or delays. We are not responsible for inaccuracies in source data.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WHOP SPORTS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability to you for all claims arising out of or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

You acknowledge that betting losses are your own responsibility and Whop Sports is not liable for any financial losses resulting from your use of the Service.

You agree to indemnify, defend, and hold harmless Whop Sports LLC, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any law or rights of a third party
• Your betting activities or gambling losses

9. Data Accuracy and Updates

We strive to provide accurate, real-time data. However, data may be delayed, incorrect, or incomplete due to factors beyond our control including:

• Third-party API outages or rate limits
• Network delays or interruptions
• Errors in source data from sportsbooks or prediction markets
• Technical issues with our infrastructure

The Service updates data approximately every 3 minutes via automated refresh. Real-time accuracy is not guaranteed. Always verify odds and data with official sources before placing bets.

10. Intellectual Property

The Service, including all software, algorithms, analytics, and content, is owned by Whop Sports LLC and protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Service for personal use only. You may not copy, modify, distribute, sell, or lease any part of the Service.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Reasons for termination may include:

• Violation of these Terms
• Fraudulent or illegal activity
• Excessive API usage or abuse
• Chargeback or payment dispute
• At our sole discretion

Upon termination, your right to use the Service immediately ceases. Sections that by their nature should survive termination shall survive (including disclaimers, limitations of liability, and indemnification).

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions.

Any disputes arising out of or related to these Terms or the Service shall be resolved through binding arbitration in Wyoming, except that either party may seek injunctive relief in court.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to the Service. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms.

Material changes (such as pricing, rate limits, or service availability) will be communicated via email at least 30 days in advance.

You must be at least 18 years old (or the legal gambling age in your jurisdiction, whichever is higher) to use the Service. By using the Service, you represent that you meet this requirement.

The Service is provided from the United States. We make no representation that the Service is appropriate or available for use in all locations. Access to the Service from jurisdictions where sports betting or the Service's content is illegal is prohibited.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Whop Sports LLC regarding the Service and supersede all prior agreements and understandings.
